Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the National Coney Island website (the "Website") or the Coney Bucks mobile application (the "Application") operated by National Coney Island ("Us", "We", or "Our").

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of the terms, You may not access the Service.

1. Description of Service

National Coney Island provides users with access to menu details, restaurant location information, online ordering, gift card services, promotional offers, customer support, and our loyalty rewards program ("Coney Bucks") via the Website and Application (collectively, the "Service").

2. User Accounts & Registration

When You create an account with Us (e.g., for online ordering or Coney Bucks rewards), You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password. You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

3. Coney Bucks Loyalty Program & Gift Cards

• Loyalty Program: Participation in the Coney Bucks loyalty program is subject to specific program rules, eligibility requirements, and promotional terms. Rewards, points, and promotional offers have no cash value, are non-transferable, and may be modified or discontinued by Us at any time without prior notice.
• Gift Cards: National Coney Island gift cards are redeemable for food and beverage purchases at participating locations. Gift cards cannot be redeemed for cash except where required by law. Lost, stolen, or damaged gift cards will not be replaced without proof of purchase.

4. Intellectual Property & Ownership

The Service and its original content, features, menu item names, logos, graphics, visual interface, and functionality are and will remain the exclusive property of National Coney Island and its licensors.

Our trademarks, trade dress, and brand imagery may not be used in connection with any product or service without the prior written consent of National Coney Island.

5. Prohibited Uses & Acceptable Behavior

You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service.
• To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service or any server, computer, or database connected to the Service.

Our Service contains links to third-party websites or services (e.g., third-party online ordering partners, social media platforms, analytics providers, and payment processors) that are not owned or controlled by National Coney Island.

National Coney Island has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that National Coney Island shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
